1) Scope of Application

1.1 These General Terms and Conditions ("GTC") apply to all contracts between Kitchen by Nature® c/o Michelangelo Kozon, Burgfrauenstraße 111A, 13465 Berlin, Germany ("Seller") and customers ("Client") regarding all goods presented in the online shop at kitchen-by-nature.com.

1.2 By placing an order, the Client agrees to be bound by these GTC. Any conflicting terms proposed by the Client are expressly rejected unless accepted by the Seller in writing.

1.3 The Seller reserves the right to amend these GTC at any time. The version in effect at the time of order placement applies to that order.

2) Conclusion of the Contract

2.1 Product descriptions in the Seller's online shop are not binding offers. They are invitations to the Client to submit a binding offer.

2.2 By clicking the final order button during checkout, the Client submits a legally binding offer to purchase the goods in the virtual basket.

2.3 The Seller may accept the Client's offer within five days by:

  • sending a written order confirmation by email, or
  • delivering the ordered goods, or
  • processing the Client's payment.

If the Seller does not accept the offer within this period, the Client is no longer bound by the offer.

2.4 The contract content will be sent to the Client by email after order submission. Registered customers can also access their order history through their account.

2.5 Before submitting the order, the Client can review and correct all entered data.

2.6 The English language is available for the conclusion of contracts for US customers.

3) Return Policy

3.1 The Seller offers a 30-day return policy from the day the Client receives the item. The Client must notify the Seller of the return request within 30 days by email to service@kitchen-by-nature.com.

3.2 The Client is responsible for return shipping costs to the Seller's address in Berlin, Germany.

3.3 Returned items must be:

  • unused and in their original condition,
  • in their complete original packaging,
  • with all included documentation, warranty cards, manuals, and accessories.

3.4 Refunds will be processed within 14 days of the Seller receiving the returned item, using the original payment method.

3.5 The following items are excluded from return:

  • Goods made to the Client's specifications or clearly personalized;
  • Goods liable to deteriorate or expire rapidly;
  • Sealed goods unsuitable for return due to health or hygiene reasons, if unsealed after delivery.

4) Prices and Payment

4.1 All prices are indicated in US dollars and include applicable taxes, customs duties, and import tariffs. No additional fees will be charged at delivery. Shipping costs are shown separately in the product description and at checkout.

4.2 Payment can be made using the methods listed at checkout. Payment is due upon order placement unless otherwise agreed.

4.3 If an item is incorrectly priced on the Seller's website and the correct price is higher, the Seller will either contact the Client for instructions before shipping or reject the order.

5) Shipment and Delivery

5.1 Goods are shipped to the delivery address provided by the Client at checkout.

5.2 In the case of unavailability of an item, the Seller will inform the Client by email as soon as possible and offer either a substitute product or a refund.

5.3 If delivery fails due to incorrect address information or failure to collect, the Client bears the cost of the unsuccessful dispatch and any redelivery.

6) Warranty and Liability

6.1 The Seller provides goods in accordance with the statutory warranty rights applicable under German law.

6.2 To the maximum extent permitted by applicable law, the Seller shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or relating to the purchase or use of the goods.

6.3 The Seller's total liability for any claim relating to a product shall not exceed the price paid by the Client for that product.

6.4 Nothing in these GTC limits liability for death or personal injury caused by the Seller's negligence, for fraud, or for any other liability that cannot be excluded under applicable law.

7) Use of the Online Shop

7.1 The Seller's online shop is provided on an "AS IS" and "AS AVAILABLE" basis. The Seller does not warrant uninterrupted, error-free, or secure access to the website.

7.2 The Seller is not liable for damages caused by viruses or malware that may affect the Client's device as a result of using the website.

7.3 External links on the website are provided for convenience. The Seller accepts no liability for the content, accuracy, or privacy practices of third-party websites.

8) Intellectual Property

All content on the Seller's website, including product photos, text, logos, and the "Kitchen by Nature®" trademark, is the property of the Seller or its licensors and is protected by copyright and trademark law. Reproduction, distribution, or commercial use without prior written consent is prohibited.

9) Force Majeure

The Seller is not liable for delays or failures in performance caused by events beyond reasonable control, including but not limited to natural disasters, pandemics, supply chain disruptions, customs delays, war, or government action. In such cases, delivery deadlines are extended accordingly.

10) Governing Law and Jurisdiction

10.1 These GTC and all legal relationships between the Seller and the Client are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

10.2 The Client acknowledges that the Seller is a German-based business and that any dispute arising from these GTC shall be resolved before the competent courts of Berlin, Germany, to the extent permitted by applicable law.

10.3 This clause does not deprive US consumers of mandatory protections they may have under the law of their state of residence.
